Where are the data breaches? The Massachusetts Office of Consumer Affairs and Business Regulation has compiled a report analyzing the data breaches that have been reported to it under the state's restrictive data breach law. As you might expect, by industry, the finance industry is the biggest arena for data breaches. In a Willie Sutton sort of way, that makes sense. The second biggest industry for data breaches is healthcare. That also makes sense, but for a different reason: there are a lot more people looking for breaches, because of a legal structure that requires participants in the industry from both sides (suppliers and consumers of healthcare) to keep close tabs on possible breaches and ferret them out.

Interestingly, the report shows that not many folks in Mass. are following the law's requirement that all data on portable devices must be encrypted.
