The plaintiff's complaint in a lawsuit is only one side of the story, but given that the hospital fired the tech, it's plausible.  Covered entities' greatest risk for a HIPAA violation these days comes from rogue employees.  Whether it's employees stealing credit card information to pay their rent or selling the data to personal injury lawyers, or just not securing data (or losing phones and laptops), a bad employee can cause serious HIPAA damage.
