I'm no expert,
may be a HIPAA violation. Oh, wait, I am an expert. . . .
Actually, it's possible
that it's not a HIPAA violation, if
the steps the physician took were reasonable and sufficient, and the breach occurred despite taking those reasonable steps. That's a subjective standard, and perhaps could be met. HIPAA doesn't require perfection, just reasonable steps for protection. But at this point, I think it's really just a matter of damages, which frankly could be huge.
