The South Carolina case challenging HIPAA has made it to the Federal Circuit court, and has been found constitutional
. There is still the Texas case (the Federal District court upheld HIPAA there too, but it's on appeal to the 5th circuit), as well as the case filed a few weeks ago, on the eve of the Privacy Rule's effective date, where the plaintiffs basically wanted to repeal the revisions to the Privacy Rule that took away the consent requirement.
