Emory Update: as might have been expected, a class action suit has been filed. No specific damages have been alleged, either in the suit or otherwise; rather, the fact that some people will have to change credit card numbers or closely watch their credit reports seems to be the basis of the proposed class action suit.

I don't know Georgia law, and whether actual damanges must be shown, but I'd be surprised if this went anywhere.

The plaintiff is Peter Bombardian, and the case has been reported by BNA (subscription required).
