HIPAA and Identity Theft: here's a short but useful article from AHA News on perhaps another prosecution of an individual employee for a HIPAA violation in connection with identity theft by the employee. We will see if this prosecution goes forward with a HIPAA claim (it needn't), given the DOJ's recent pronouncement that employees of covered entities can't actually violate HIPAA unless there's an Enron-style case of the employees causing both corporate and individual liability.
