A Federal Data Security law? As you know several states (notably California and Texas) have recently passed legislation either imposing on business that hold and use personal information, such as credit card or social security numbers, particular requirements to (i) have in place policies and procedures to protect that informatin and (ii) notify customers whose information has been stolen. Now, it looks like the federal government may be jumping into the fray with this bill. It will be interesting to see how a federal law and state laws will interact; will the federal law preempt, or will it be preemption only for less-protective statutes, like with HIPAA preemption? Time will tell. . . .
