Privacy Statistics: This according to HIPAAwire, although I can't find an official government pronouncement outlining these stats:
- 12,000 privacy complaints.
- 65% of complaints closed, often because the offense occurred prior to the effective date of the rule, the perpetrator isn't a covered entity, or HHS lacked jurisdiction.
- Top five complaints: (i) improper use/disclosure, (ii) lack of safeguards, (iii) failure to provide an accounting, (iv) violation of the minimum necessary rule, and (v) failure to get an authorization where needed.
- Ccomplaint targets line out according to level of patient contact: private physicians got the most complaints, followed by hospitals, pharmacies, outpatient facilities, and group health plans.
